The seventh swing seat should be appointed by the president giving a moderate advantage to the party in power. That said, the point of no term limits was to not be able to vote out a justice for a controversial (or party defying) decision. The court really needs to be impartial which doesn’t work in that scenario or the current situation.

I hate the idea of “expanding the court” because we all know that if Dems add four justices now, Republicans will just add five more when they take control – and it continues until we have more justices than Senators. There is zero long-term good that can come from expanding the Court. A far more elegant solution is that every justice gets a 18-year term and each president gets two appointments per four-year term. If a justice dies or retires while in that term, the current president gets to appoint an interim justice for the remainder of that 18-year term. Majority vote from Senate is all it takes to confirm. So, winning presidential races still matters and a 12-year stretch of one party owning the White House can turnover 2/3 of the seats and swing the court.
