Higher turnout would have fixed those problems pre-emptively. Bernie would have been the nominee in 2016 instead of the inevitable party favorite. I think his point is that it’s not realistic to change the system unless voter turn out is first increased to historic levels. So the focus should be put on grass roots voter increase rather than assuming some change to something enshrined in the constitution will happen first.

We already know that the GOP has no issue replacing a judge with minimal lead time. Why wouldn’t they just replace any judge that is about to hit a limit (especially after losing an election) with a new judge prior to losing power? This rule would only apply to Dems and give the GOP another way to force out any dissenting options while ignoring rules for themselves. I think we need definable categories for justices (Conservative, Moderate, Liberal), and we need them to declare themselves when becoming circuit judges. Then, we allocate three for each category. When a Conservative dies, a Conservative fills the spot, etc.
